Who Needs to Fill Out I-9 Form?
Every employer in the United States must complete Form I-9 for each employee hired after November 6, 1986. Both U.S. citizens and noncitizens must complete the form. As an employee, you complete Section 1 on or before your first day of work. Your employer completes Section 2 by examining your original identity and work authorization documents within three business days of your start date. Employers must retain completed I-9 forms for three years after the hire date or one year after employment ends, whichever is later.
How to Fill Out I-9 Form: Step-by-Step Instructions
- 1Section 1 (Employee): Enter your full legal name, any other last names used, address, date of birth, and Social Security number (if applicable).
- 2Check your citizenship/immigration status: U.S. citizen, noncitizen national, lawful permanent resident, or noncitizen authorized to work.
- 3If you are a lawful permanent resident, enter your USCIS or Alien Registration Number. If you are a noncitizen authorized to work, enter your work authorization expiration date and the applicable USCIS number, Form I-94 admission number, or foreign passport number.
- 4Sign and date Section 1. If you used a preparer or translator, they must complete the Preparer/Translator Certification.
- 5Section 2 (Employer): Examine the employee's original documents. Accept documents from List A (proving both identity and work authorization) OR one from List B (identity) AND one from List C (work authorization).
- 6Enter the document title, issuing authority, document number, and expiration date for each document examined. Sign and date Section 2.
When Is I-9 Form Due?
Section 1 must be completed by the employee on or before their first day of employment. Section 2 must be completed by the employer within three business days of the employee's first day of work. For example, if an employee starts on Monday, Section 2 must be completed by Thursday. Employers must re-verify expired work authorization documents before they expire using Section 3.

What documents do I need for Form I-9?+
You need either one document from List A (which proves both identity and work authorization, such as a U.S. passport or Permanent Resident Card) OR a combination of one document from List B (identity, such as a driver's license) AND one document from List C (work authorization, such as a Social Security card). Your employer must accept any valid documents you present — they cannot request specific documents.
Can I complete Form I-9 before my first day of work?+
Section 1 can be completed as early as when you accept the job offer, but no later than your first day of work. Section 2 (employer portion) cannot be completed before your first day of work, but must be completed within three business days after.
Does my employer keep the I-9 or send it to the government?+
Employers retain completed I-9 forms — they do not send them to USCIS or any government agency unless specifically requested during an inspection or audit. Employers must keep the forms for three years after the hire date or one year after employment ends, whichever is later.
Do U.S. citizens need to fill out an I-9?+
Yes. Every employee hired in the United States must complete Form I-9, regardless of citizenship status. U.S. citizens, permanent residents, and authorized noncitizens all must complete the form.
What if my work authorization expires?+
If your employment authorization has an expiration date, your employer must re-verify your status before it expires using Section 3 of the I-9. You will need to present an unexpired document showing you are still authorized to work.
