Who Needs to Fill Out 1099-MISC Form?
File Form 1099-MISC if you paid at least $10 in royalties or broker payments in lieu of dividends or tax-exempt interest, or if you paid at least $600 in rents, prizes and awards, medical and health care payments, crop insurance proceeds, cash payments for fish, payments to attorneys, or other income. This form is NOT used for nonemployee compensation (use 1099-NEC instead). Common filers include landlords reporting payments to property managers, businesses paying rent for office space, and companies making prize or award payments.

When Is 1099-MISC Form Due?
Copy B must be sent to the recipient by January 31. If filing by paper, Copy A is due to the IRS by February 28. If e-filing, Copy A is due by March 31. If the date falls on a weekend or holiday, the deadline extends to the next business day.
Penalties for Not Filing 1099-MISC Form
Penalties for late or incorrect filing range from $60 to $330 per form depending on how late you file. Intentional disregard of filing requirements results in a $660 penalty per form with no maximum. Failing to furnish correct payee statements carries the same penalties.

When do I use 1099-MISC vs. 1099-NEC?+
Use 1099-NEC for nonemployee compensation (payments to contractors for services). Use 1099-MISC for all other miscellaneous income types: rents, royalties, prizes, medical payments, attorney payments (non-service fees), crop insurance, and other income not categorized elsewhere.
Do I need to file 1099-MISC for rent payments?+
Yes, if you paid $600 or more in rent during the year in the course of your trade or business. This includes rent for office space, equipment, and vehicles. Personal rent payments (like your apartment) do not require a 1099-MISC.
Is prize money reported on 1099-MISC?+
Yes. Prizes and awards of $600 or more that are not for services performed are reported in Box 3 of 1099-MISC. If the prize was for services (such as winning a contest related to your profession), it would be reported on 1099-NEC instead.
Do I need to report payments to corporations?+
Generally no. Most payments to C corporations and S corporations are exempt from 1099 reporting. However, there are exceptions: medical and health care payments (Box 6) and attorney payments (Box 10) must be reported regardless of the recipient's corporate status.
What if I made an error on a filed 1099-MISC?+
File a corrected 1099-MISC by checking the 'CORRECTED' box at the top of the form. You must file a corrected form for both incorrect amounts and incorrect recipient information. E-filed corrections can be submitted through the same IRS FIRE system.
